Home Growing Is Legal in Maine
Adults 21 and older can grow cannabis at home in Maine under Title 28-B. The rules are generous and, critically, municipalities cannot ban home cultivation. State law guarantees a minimum of 6 plants per resident regardless of local ordinances.
A municipality may not prohibit the personal cultivation of cannabis by a person 21 years of age or older. A municipality may enact a reasonable limitation on personal cultivation but may not limit personal cultivation to fewer than the amounts allowed under this chapter.
Title 28-B — Municipal Home Grow Protections
Plant Limits
Each person (not household) may grow:

These limits are per person, not per household. In a household with two adults 21+, you could legally have 12 mature plants, 24 immature plants, and unlimited seedlings. Medical patients have the same plant limits but enjoy significantly higher possession limits for harvested cannabis (up to 8 pounds at home).
Tagging Requirements
All home-grown cannabis plants must be properly tagged:
- Each plant must display a tag with your name and identification number
- Tags must be securely attached and legible
- This requirement applies to both recreational and medical home grows
The tagging requirement helps law enforcement verify that plants belong to a legal home grower. Untagged plants could be treated as unlicensed cultivation.
Visibility Rules
Home-grown cannabis plants must not be visible from a public way. This means:
- Outdoor plants must be screened by fencing, walls, or other structures so they cannot be seen from roads, sidewalks, or other public areas
- Indoor grows are inherently compliant with this rule
- A greenhouse or grow tent satisfies the visibility requirement
Municipalities Cannot Ban Home Grow
This is one of Maine's most important cannabis protections. State law explicitly prohibits municipalities from banning home cultivation. While towns can impose "reasonable limitations," they cannot limit cultivation to fewer plants than state law allows (6 mature, 12 immature, unlimited seedlings per person).
This stands in contrast to the opt-in system for commercial cannabis, where 85% of municipalities have not allowed retail stores. Even in a town with zero dispensaries, your right to grow cannabis at home is protected by state law.
Landlord and Rental Considerations
If you rent your home, additional rules apply:
- Written landlord permission is required before cultivating cannabis in a rental property
- Landlords can refuse permission — there is no obligation for landlords to allow cultivation
- Growing without permission could be grounds for lease termination
- Even with permission, all other cultivation rules (tagging, visibility, plant limits) still apply
If your landlord verbally agrees to let you grow, get written confirmation. A text message or email is better than nothing, but a signed addendum to your lease is ideal. Verbal agreements are difficult to enforce if a dispute arises.
Growing Tips for Maine's Climate
Maine's northern climate presents unique challenges and opportunities for home growers:
- Short outdoor season: Maine's growing season typically runs May through October. Most outdoor growers start seeds indoors in April and transplant after the last frost
- Autoflower varieties can be particularly effective in Maine, as they flower based on age rather than light cycle and can finish before fall weather sets in
- Indoor growing is popular year-round and avoids weather dependency entirely
- Harvest timing is critical — early frost can damage or destroy outdoor plants. Monitor weather closely in September and October

- Personal use: Consume your own harvest, subject to possession limits (2.5 oz rec / 8 lbs medical)
- Gift to adults 21+: You may give cannabis to other adults, but not sell it
