Visitors Are Welcome: Same Rules Apply

Out-of-state visitors can legally purchase and consume cannabis in Maine under the same rules as residents. There is no residency requirement for recreational cannabis. All you need is a valid government-issued photo ID proving you are 21 or older.

Accepted forms of ID include:

  • Driver's license from any U.S. state or territory
  • State-issued ID card
  • U.S. passport or passport card
  • Military ID
  • Valid foreign passport (for international visitors)

Recreational Visitor Limits

Visitors are subject to the same possession limits as Maine residents:

  • 2.5 ounces total (max 10g concentrate)
  • 2.5 ounces per transaction at licensed retail stores

Maine offers one of the most generous medical reciprocity programs in the country. If you are a medical cannabis patient from a reciprocal state, you can use your home-state card in Maine with:

  • No registration fee
  • No additional application or paperwork
  • Same access as Maine medical patients at both dispensaries and caregivers

If you have a medical card from your home state, bring it to Maine even if you plan to buy recreationally. Medical visitors get access to the caregiver market (lower prices, craft products), higher possession limits (up to 8 lbs at home), lower taxes (5.5% vs. 14%+), and additional employment and housing protections.

Statewide Delivery: Even in Opted-Out Towns

One of Maine's most visitor-friendly features is legal statewide delivery. Licensed retailers can deliver cannabis to any address in Maine, even in municipalities that have opted out of retail stores. This is particularly valuable for visitors staying in rural areas or resort towns that may not have nearby dispensaries.

Since only about 15% of Maine's municipalities allow retail dispensaries, delivery can be essential for visitors outside of Portland, Bangor, and other opt-in communities.

The New Hampshire Border: A Critical Warning

Many visitors to Maine travel through or from New Hampshire, where cannabis laws are dramatically different:

  • New Hampshire has not legalized recreational cannabis. Possession remains illegal for non-medical purposes
  • Crossing the state line with cannabis is a federal crime (interstate drug trafficking) regardless of the legal status in either state
  • This applies even if you are driving from one legal state through New Hampshire to another legal state
Do Not Cross State Lines with Cannabis

Transporting cannabis across any state border is a federal crime — even between two legal states. If you drive to Maine from Massachusetts through New Hampshire, you cannot legally carry cannabis through NH. Buy in Maine, consume in Maine, and leave your cannabis behind when you depart.

Where Visitors Can Consume

This is the biggest challenge for tourists. Maine's consumption rules are restrictive:

  • Private property with owner permission is the only fully legal option
  • No consumption lounges (LD 1365 pending but not enacted)
  • Most hotels and vacation rentals prohibit cannabis — ask before booking
  • Public consumption is a $100 fine
  • Acadia National Park is federal land — cannabis is completely illegal there

Visitor Tips for Maine

  • Bring your medical card if you have one. Even the $0 reciprocity savings on taxes and caregiver access make it worthwhile
  • Plan your consumption location first. Buy cannabis only after confirming you have a legal place to use it
  • Use delivery. If you are staying outside an opt-in town, licensed delivery services reach every corner of the state
  • Leave Acadia clean. Do not bring cannabis into any area of Acadia National Park — federal law applies
  • Do not take cannabis home. Leave any remaining cannabis in Maine. Crossing state lines is a federal offense
  • Edibles are discreet. For visitors without a private smoking location, edibles and capsules are the most practical consumption method
  • Store cannabis safely in vehicles. Keep it sealed in the trunk to avoid open container violations
