The Opt-In Challenge
Unlike most legal states where municipalities opt out, Maine uses an opt-in system for retail cannabis. Only about 75 municipalities (roughly 15%) allow retail dispensaries, while approximately 128 (26%) allow some type of cannabis license. That means 85% of Maine's ~500 municipalities do not allow retail cannabis stores.
However, delivery is legal statewide — even into towns that have opted out of retail. Personal possession, use, and home cultivation are also legal everywhere.
