Current Possession Limits

Maine's possession limits differ significantly between recreational and medical users. The recreational limits were updated in 2023 by P.L. 2023, c. 220 and c. 396, increasing the concentrate allowance from the original 5 grams to 10 grams.

Category Recreational (21+) Medical (certified patient)
Flower possession 2.5 ounces total 8 pounds at home
Concentrates 10 grams (within 2.5 oz total) Included in 8 lb limit
Home plants (per person) 6 mature, 12 immature, unlimited seedlings 6 mature, 12 immature, unlimited seedlings
Purchase per transaction 2.5 ounces No daily/monthly caps

Recreational limits updated by P.L. 2023, c. 220 and c. 396. Medical patients enjoy significantly higher limits.

Outdated 5g Concentrate Limit

Many websites, guides, and even some dispensary staff still cite the old 5-gram concentrate limit. As of 2023, the correct limit is 10 grams of concentrate within the 2.5-ounce total. The update was enacted through P.L. 2023, c. 220 and c. 396.

Recreational Limits Explained

For adults 21 and older under Title 28-B:

  • 2.5 ounces total — this is the combined weight of all cannabis products in your possession
  • Maximum 10 grams of concentrate — concentrates (wax, shatter, oil, etc.) count within the 2.5-ounce total but are capped at 10 grams
  • 2.5 ounces per transaction — this is the maximum purchase at a licensed retail store

The 2.5-ounce limit is a combined total, not separate limits for different product types. For example, if you have 2 ounces of flower and 8 grams of concentrate, you are within the limit. If you have 2 ounces of flower and 12 grams of concentrate, you exceed the concentrate cap.

Medical Patient Limits

Certified medical patients under Title 22 Chapter 558-C enjoy dramatically higher limits:

  • Up to 8 pounds at home — this includes all forms of cannabis (flower, concentrates, edibles, etc.)
  • No daily or monthly purchase caps — patients can buy as much as they need per visit
  • Concentrates included within the 8-pound total — no separate concentrate cap

The 8-pound limit is designed to accommodate patients who grow their own medicine, buy in bulk from caregivers, or process their harvest into concentrates and edibles. For details on becoming a patient, see Medical Program.

Home Cultivation Allowances

Both recreational and medical users can grow cannabis at home:

  • 6 mature plants per person
  • 12 immature plants per person
  • Unlimited seedlings per person

The harvest from home-grown plants is covered by your applicable possession limit (2.5 oz recreational or 8 lbs medical). Municipalities cannot ban home cultivation. For full cultivation rules, see Home Cultivation.

What Happens If You Exceed the Limit?

Exceeding possession limits carries escalating consequences:

Offense Classification Penalty
Public consumption Civil violation $100 fine
Over limit (2.5–8 oz) Class E crime Up to 6 months / $1,000
Open container in vehicle Civil violation Fine
OUI first offense Criminal $500 min fine + 48 hrs jail
OUI fourth offense Class C felony 6 months min jail
Unlicensed sale Criminal Varies by quantity

Possession of 2.5 to 8 ounces by a recreational user is a Class E crime, punishable by up to 6 months in jail and/or a $1,000 fine. Amounts beyond 8 ounces carry more severe charges. For the full breakdown, see Penalties.

Visitors and Possession Limits

Out-of-state visitors are subject to the same possession limits as Maine residents:

  • Recreational visitors (21+): 2.5 ounces total, max 10g concentrate
  • Medical visitors (from 29 reciprocal states + DC): Same limits as Maine medical patients, including the 8-pound home limit

See Out-of-State Visitors for more information.

Comparing Maine to Neighboring States

Massachusetts 1 oz public / 10 oz home 10 oz (60-day supply)
Vermont 1 oz 2 oz
New Hampshire Illegal (medical only) 2 oz per 10 days

Maine's 8-pound medical limit is among the highest in the nation, reflecting the state's deep commitment to patient access and the caregiver model.
